RECHAZAN LIBERAR BAJO PALABRA A JOSÉ LÓPEZ Y RATIFICAN FIANZA DE 85 MILLONES DE PESOS
El exsecretario de Obras Públicas José López deberá pagar 85 millones de pesos como fianza si desea acceder a la libertad condicional en la causa en la que está condenado por enriquecimiento ilícito, al serle rechazado un planteo para obtener ese beneficio con una caución juratoria.
La decisión fue del Tribunal Oral Federal 1, que denegó un pedido de su defensa oficial en la investigación donde resultó condenado a seis años de prisión, tras ser sorprendido intentando ocultar bolsos con 9 millones de dólares en un monasterio de General Rodríguez, el 14 de junio de 2016, según el fallo al que tuvo acceso Télam.
«La caución real es la única que resulta apropiada, atendiendo a las particulares circunstancias del presente caso; y que puede funcionar como un disuasivo para que el encartado López no intente eludir el accionar de la justicia ante la solución liberatoria», sostuvieron los jueces Ricardo Basílico y José Michilini.
«De acuerdo a las constancias obrantes en la causa, entendemos que su situación patrimonial -con ello nos referimos a los inmuebles que serían de su propiedad en las provincias de Santa Cruz y Tucumán, y las acciones societarias que registraría a su nombre-, nos permite sostener como válida y razonable la caución», agregaron.
En desacuerdo, el tercer integrante del TOF1 Adrián Grunberg se mostró a favor de concederle la excarcelación bajo juramento pedida por la defensora oficial Pamela Bisserier, al entender que no hay riesgo de fuga.
El fiscal de juicio Miguel Ángel Osorio había dictaminado en contra de la sustitución de la caución real impuesta a López.
López fue condenado a seis años de cárcel por enriquecimiento ilícito y a una multa de 60 por ciento del valor de ese enriquecimiento, en un fallo que está apelado.
Esa condena se unificó con otra anterior por portación ilegal de arma de fuego en 7 años y seis meses de cárcel.
La decisión del Tribunal podrá ser apelada ante la Cámara Federal de Casación, pero mientras tanto el exsecretario de Obras Públicas seguirá preso.
